Renting without an agent: how to tell you are dealing with the owner

You are messaging about a listing and cannot tell who is on the other end: the owner, a friend of his, or someone who lives off commission. An intermediary is not a forbidden profession; the only question is who pays them. Local practice says the landlord does — yet foreigners are often charged for the same work twice. Below: how to tell in five minutes, which documents to ask for, and where subletting ends and fraud begins.

How many intermediaries are actually out there

Of the 2,180 live listings in the database, 36% are posted by agents and agencies; the rest come from owners and residents. Behind the figure: 46 sources. Data as of August 16, 2026.

That is not an eyeball estimate: the platforms mark professional sellers themselves and we carry the mark into the card. The practical conclusion — roughly every third listing you discuss will not be with the owner, and that is fine right up to the moment the commission is asked of you.

What an intermediary costs you

  • The feehalf to a full month's rent, and up to two months on long contracts. Normally the landlord pays it. If “phí môi giới” is asked of you, you are paying for work already paid for on the other side.S1
  • The mark-upsometimes there is no fee because it is already inside the rent: the same flat is cheaper from the owner.
  • Nobody to call afterwardsan intermediary does not fix the air conditioner, does not declare your stay to the police and does not return your deposit. Those are the owner's duties, and after signing it is the owner you will be talking to.

Six signs that this is not the owner

  1. The same phone number sits on dozens of listings across districts and price ranges.
  2. A reverse image search finds the photos on other sites, sometimes in another city.
  3. The ownership certificate will not be shown “until you put down a viewing deposit”.
  4. The commission came up in conversation before the flat did.
  5. You only ever meet at the gate of the complex, and the owner is never produced.
  6. In the draft contract the counterparty is a “manager” with no notarised power of attorney.

No single sign proves anything: an honest agent also has many listings. But when four or five line up, you are talking to the wrong side — and it is time to ask for documents.

What to ask the landlord for before any money moves

  • The ownership certificate (sổ hồng / sổ đỏ)without it renting to a foreigner is not allowed at all: Articles 171–173 of the Housing Law 2023 require a certificate, a detached house or a self-contained apartment, no dispute and working utilities. So the request is a check on the legality of the deal, not personal distrust.S2
  • ID (CCCD) or passportthe name must match the one on the certificate.
  • A notarised power of attorneyif the signer is not the owner. Without a notary that paper means nothing.
  • An electricity or water billin the owner's name — a quick indirect check that is hard to prepare in advance.

A photo of a document in a messenger confirms nothing. Property data is double-checked at the ward people's committee where the property is, or at the district land authority — the same route people use before buying.S3

Subletting: when it is lawful and when you get evicted

A rented home may be re-let only with the owner's written consent. Without it, subletting is a direct ground to terminate the lease unilaterally (Housing Law 2023, Article 172(2)). For you that means: if you rented from a tenant rather than the owner, your contract ends together with theirs — and without your involvement.S4

Which is why “are you the owner or are you renting yourself?” is not a tactless question but a way to find out whether a third signature is needed.

Red flags that mean fraud

  • Money before the viewing“pay to hold it” is the most common scheme: once the transfer lands, the contact disappears. Police repeat this warning year after year.S5
  • A price far below the marketcompare it with the city median: half the going rate is bait, not luck.
  • Urgency“two other people are viewing today” is a sales tool, not a fact.
  • Fake pagesthe Da Nang city administration warned separately about counterfeit websites and Facebook pages of apartments and hotels: 30–50% prepayment to an account named after the property.S6
  • Someone else's flata person books a place by the day, gets the keys and the access card and re-lets it as their own; that scheme is in the police warnings too.S5

If the money is already gone

  1. Keep everything: the correspondence, a screenshot of the listing with URL and date, the receipt, the account and phone numbers.
  2. File a report with the ward police (công an phường) — where the flat is or where you live.
  3. Call your bank with the transfer details: in the first hours funds can sometimes be frozen.
  4. Report the listing to the platform — taking it down cuts the number of the next victims.

How to search directly

  • “Cho thuê” signs on the buildings themselvesthe most direct route to an owner and usually the lowest price.
  • The building management (ban quản lý)in newer complexes they keep the list of flats for rent and the owners' phone numbers.
  • Local Facebook and Zalo groupsthey work, but most intermediaries live there too — the signs above apply one for one.

Checklist

  1. Who is in front of me: owner, attorney-in-fact, intermediary or tenant.
  2. The certificate was shown and the name matches the ID.
  3. A notarised power of attorney if the signer is not the owner.
  4. The commission stated out loud: how much, to whom, for what.
  5. If a tenant is letting the place — the owner's written consent.
  6. No money before the viewing and before signing.
  7. Payment to the counterparty of the contract, not “to my brother's card”.
